Crazy seizure driver; rear ended our client in Groton, Connecticut

Crazy driver with a known seizure disorder crashes into our client at full speed from behind.  Settlement, large sum.  Confidential. 

In this case our client was driving on Rt.1 in Groton heading north at the point where Rt.1 becomes Rt.12, just at the Rt.95 overpass.  Anyone from Groton, knows this area.  Out client was stoped at a light, and was struck from behind.  Impact was heavy.  

What we eventually discovered was that this defendant suffered from a seizure disorder, and suffered a seizure while driving his car.  Or at least that is what he claimed.  The seizure problem was a known problem, but the seizures were rare.  The last seizure happened within the past year, and occurred while the defendant was driving.  Thus, the defendant was aware of his seizure problem, and drove his car anyway.  The seizure issue was very serious, and when a seizure occurs the defendant is totally unable to control the car for about 1 minute. 

The issue in this case was damages.  How much was our client going to receive at trial?

Our client suffered a concussion, but not serious neck or back injuries.  The concussion caused headaches for our client.  A concussion is a type of brain injury.  In this case there was little evidence of a bring injury on a CT scan or MRI, but our client still suffered greatly.  Our client was unable to work due to her headaches, and concentration problems, and she ended up leaving her job.  

The issue in the case was whether the jury was going to attribute all of our client’s problems to the car accident when there was no objective evidence on the MRI.  

The case went on for about two years, and we prepared for trial.  

In this case, the defendant happened to be a retired doctor, and he carried large sum of insurance on his vehicle.  This was significant because the large insurance policy exposed the defendant’s carrier to a large potential jury award.  

Our client was very interested in reaching a settlement before the case proceeded to trial.  

The case settled for a large confidential sum, and our client was very happy.
