In a divorce case, what are the issues?

In a divorce case one or both people who are in a marriage, seek to end a marriage.  A long time ago, people were required to prove fault in order to obtain a divorce.  That is not the rule today.  Connecticut is a no-fault divorce state.  Thus, you are not required to prove fault in a divorce case.  As a result, anyone can receive a divorce even if the other spouse wants to remain married.  The trick to a divorce case is not to simply get divorced, but to obtain favorable orders as part of the divorce.  

In divorce cases, the parties seek to divide assets.  If child custody is disputed, then that is also decided as part of the case.  In your divorce case, you must share your financial information with the other side.  To do so, you will be required to submit a detailed financial affidavit. The financial affidavit will need to be accurate and signed under oath.    

Assets such as the family home, real estate, a business, and pensions must be valued, and divided properly.  State and federal tax laws, and federal pension laws must be considered.  As a result, a divorce case is never as simple as dividing your assets in half.  With significant assets at stake, you must seek the help of an experienced divorce and family law lawyer.
