Pedestrian was struck by a pickup while walking in a crosswalk in Uncasville, Connectcut.  She had a low back injury which was non-surgical. She made great efforts to help herself to avoid surgery.  She followed her doctors advice, and tried everything under the sun to improve her health without surgery.  She was fearful of surgery, and elected not to have surgery.  She ended up with a permanent back injury, but she was able to continue her job.  He lives with her daily pain.  Her activities are greatly limited, and she did a great job in her deposition describing her pain.  Her medical bills were over $15,000.00 due to the fact that she has massive amounts of physical thereapy which was helpful to her. Unforltunatley, the defendant carried only $50,000.00 in liability coverage. The defendant tendered the policy limits.

After we obtained the $50,000.00 from the driver of the pickup (tortfeasor) we brought an underinsured motorist UIM claim against our client’s automobile insurance carrier.  In an underinsured motorist claim the underinsured motorist carrier was entitled to a credit for the amount received from the tortfeasor (in this case $50,000.00).  Therefore, unless a jury were to award over $50,000.00 after a trial the underinsured motorist carrier would end up paying nothing.  We were able to settle the case with the UIM carrier for an additional $15,000.00 bringin the total settlement to $65,000.00.

Our client was very happy to have this case behind her.  All of her bills were paid and she was able to have sizable sum of money in her pocket as compensation for her pain, and to pay for future medical bills as needed.
