This case is a fall down case. The fall was on ice and snow on a sidewalk in New Haven. The rule in New Haven is that the property owner must clear their sidewalk of ice and snow within 24 hours of the snow event. Here, that did not happen. The property owner was a commerial real estate developer. The defendant claimed he hired people to clear the snow. The plaintiff and her witness claimed the snow was never cleared. The plaintiff suffered a serious neck injury and required surgery. The plaintiff’s emergency room records were full of references to a potential different fall which significantly complicated the issues in the case and favored the defendant. The case settled during a mediation before jury selection for $400,000.00.
