Our client was working for a large chain home supply store when he suffered an injury on the job.  He sought medical care from the employer sponsored medical provider as required under the store’s policy.  He was out of work for a few days, and his boss frequently asked when he was going to get back to work.  Our client was abrubtly discharged after he reported to his boss that he was no cleared to go back to work.  Of course, the employer claimed that the real reason he was discharged was due to an unrelated investigation into his conduct that, if true, was grounds for discharge.

Issues in a case like this include:

Whether the plaintiff was fired in retaliation for exercising his rights under the Workers Compensation Act or if he was fired to some other valid reason.

Whether the plaintiff make an adequate job search to try to find new work.  If he did not, then he did not mitigate or minimize his damages, and his claim for lost wages would not succeed.

Whether the plaintiff suffered some sort of non-economic harm form his claimed wrongful termination.
