Seat Back Failure | Wrongful Death | Crashworthiness.

The seat belt is supposed to keep you in your seat at impact if you are in a car crash.

Our client lost her life when she was in a rear-end crash on the highway in Colchester, Connecticut, and her seat back failed.

What is seat back failure?

Seat back failure occurs when the joint in the seat breaks.  As a result, the back of the seat no longer supports the person in the seat.  If the seat back breaks the person will fall back as if they a lying down in the car, and the seat belt will not support the person in the seat.

Facts of the case.

In this case our client was rear ended on the highway.  Her seat back failed.  Her seat belt no longer provided support to hold her in her seat. The car rolled over and the force of the roll cause her to be thrown from the car.  We brought suit against the driver of the car that rear ended our client, her underinsured motorist carrier, and General Motors.  We investigate the crash and the car and discovered that the seat back failed.  We were able to achieve a settlement for our client’s estate.
