The plaintiff, “M.E”, was driving her car heading north on Rt. 1 in Weserly, Rhode Island.  She was hit by a car that was exiting the parking lot from a shopping center.  The defendant’s car drove directly into her path.  She had no chance to avoid the crash.  the cars collided.  It was a heavy impact.

The plaintiff suffered a comminuted right talus fracture (bone in ankle).  She was fitted with a non-weight bearing cast which did not result in a successful union of the bones.  This means the bones did not heal well.  She was very concerned that she was no going to be able to walk the way she did before the crash.  She underwent an open reduction and internal fixation (2 screws) of the ankle and subsequent physical therapy treatments.  The surgery was painful, but she was very brave.  She went through a lot of physical therapy.  Ultimately she suffered a 20% impairment of the right ankle due to swelling, pain, stiffness and loss of mobility.  Her doctor stated that she had a greater than 50% chance of requiring medial screw removal.
