This accident occurred in a large parking lot at a large shopping center in Groton, Connecticut. For those in the area it is probably well known to you. It is the one where Super Stop and Shop and Kohls are located. Off of Rt. 12 in Groton, Connecticut.
Our client was an elderly lady. She had a handicap sticker on her car. She parked in a handicap parking spot.
The hazard in this case was an uneven surface where the parking lot met the sidewalk. Also, it was difficult to see. Uneven walking surfaces are particularly dangerous in areas where level surfaces are expected. Here, there was a raised portion where the parking lot me the sidewalk.
When she exited her car she was caused to fall due to a raised portion of the parking lot which meets the sidewalk. This was a very hazardous area because of the uneven surfaces and the fact that it was difficult to see.
Our client fell on her side permanently injuring her arm and leg. She had a left arm fracture which required open surgery to repair.
This case was settled prior to trial. The case was Rose Morgan v. KRT Properties, Inc.
