What is No Fault Insurance

What is no fault insurance?

No fault insurance is a type of automobile insurance that pays on a claim regardless of who is a fault.  In a no fault insurance state like New York you can’t sue the other party (even if they are at fault) unless your damages meet a certain threshold.  Instead, you will make a claim against your insurance who will pay the claim.  This does not mean that the at-fault driver gets away with it.  Your carrier will seek reimbursement from the at fault carrier.  
 
For example: The other driver is a fault, and has caused you $2000.00 in emergency room bills a Lawrence & Memorial Hospital in New London, but they determined that you are fine.  Thus, your only damages are $2,000.00 in medical bills.  In a no fault state, you could not sure the at fault party because $2,000.00 is below the threshold.  Instead, you make a $2,000.00 no fault claim on your own policy.
 
Many states like Connecticut, do not use the no fault system.  Instead, you have the right to sue the at fault driver for all claims, and must prove that the other drive was at fault, and caused your harms, losses, and damages. Connecticut uses a comparative fault system.  
For example: In a comparative fault state like Connecticut, using the example above, you could sue the at fault party for the $2000.00 in medical bill plus something fair, just, and reasonable for your pain, suffering, and loss of life’s pleasures.  

Is there no fault insurance in Connecticut or any of the border states?

Connecticut is a fault based insurance state.

Rhode Island is a fault based insurance state.

New York has no fault insurance. 

Massachusetts has no fault insurance.  

What are the main parts of an automobile liability insurance policy in Connecticut?

Automobile liability policies consist of a few parts.  

  • Liability coverage.  This pays a claim against you if you are at fault. 
  • Underinsuring/uninsured motorist.  This covers you if someone else is at fault, and they don’t have any or enough insurance to pay your claim. 
  • Property damage.  This pays for property damage to your vehicle in some circumstances. 
  • Medical payments.  This pays for medical bills in a car accident in some circumstances. 

WHAT CAN I SUE FOR?

You can sue for compensation for all of your harms and losses.   In most cases, you can sue for the following types of damages:

Wrongful death;

Medical bills;

Lost wages;

Personal injuries;

Lost of enjoyment of activities;

Past and future losses;

The the lesser of the cost to repair your car, or total value;

Loss of use of the car.
