In this case the defendant ran his red light while the plaintiff had a green arrow.  There was a heavy collision.  The defendant admitted to drinking two to five beers at a friends house before driving home to Groton.The our client was a food delivery driver for a local Chinese restaurant.  He was working (delivering food) at the time of the crash. The plaintiff suffered a bad shoulder injury.  He had a Grade III AS separation which is a completely separated shoulder.  He need immediate medical care.  Our client had no health insurance.  He needed medical care, but had no way to get pay for it.

We helped our client get medical care, and wage replacement benefits.

First, our client needed medical care, and needed our car accident lawyer help.  Since the car accident occurred while our client was working delivering Chinese food he was entitled to Workers Compensation benefits.  We filed a Workers Compensation claim.  As a result he was able to get his medical bills paid through Workers Compensation.

Thus, even though our client had no health insurance at all, we were able to get him the medical care he needed through Workers Compensation.

He had the Weaver-Dunn procedure to attempt to correct his shoulder.

The plaintiff incurred about $26,000.00 in medical bills.  He also lost wages, which were paid by the workers compensation carrier.

We sued the drunk driver.  The drunk driver had only $50,000.00 in automobile liability coverage.

In our view the value of the far exceeded the defendant’s insurance.

In this case the our client was limited to the insurance available from the defendant.  Unfortunately, our client did not have underinsured motorist coverage available to him because he had only a small automobile insurance policy for himself.  As a result, our client was unable to bring an underinsured motorist claim.

This case is an example of a case in which the our client would have recovered much more money had he carried a larger amount of underinsured motorist insurance.  The lesson to learn is always make sure you have as much underinsured motorist insurance as you can possibly afford.  You never know when you will be a victim of a serious car accident.
