Seat back failure crashworthiness case.

This case is a seat back failure case.   Your seat belt is supposed to keep you in your seat at impact during a car crash.  Naturally, however, your seat belt won’t work, if the seat, on which the seat belt is located, collapses.

What is seat back failure?

Seat back failure occurs when the joint in the seat breaks.  As a result, the back of the seat no longer supports the person in the seat.  If the seat back breaks the person will fall back as if they a lying down in the car, and the seat belt will not support the person in the seat.

Facts of the seat back failure case.

In this case our client was rear ended on the highway.  Her seat back failed.  Her seat belt no longer provided support to hold her in her seat. The car rolled over and the force of the roll cause her to be thrown from the car.  We brought suit against the driver of the car that rear ended our client, our client’s underinsured motorist carrier, and General Motors.  After we investigate the crash and the our client’s car we discovered that the seat back failed.  The seat back should not have failed.  As a result, we were able to bring a product liability case against the maker of our client’s car, General Motors.   We were able to achieve a settlement for our client’s estate.
